5. Information Required

6. Investigation Process
Upon receipt of a complaint containing sufficient information to assess the concern, The iCaseTheory may:
- acknowledge receipt of the complaint;
- review the information provided;
- seek clarification where necessary;
- consult the relevant supplier or manufacturer where appropriate;
- assess the alleged infringement in good faith.
iCaseTheory may request additional supporting documents before making any determination.
7. Temporary Removal of Content
Where iCaseTheory reasonably believes that a complaint raises a genuine issue, the Company may, without admitting infringement or liability:
- temporarily remove the relevant Product;
- suspend access to the Product listing;
- modify Website content;
- restrict further sales pending investigation.
Any temporary action taken while a complaint is reviewed does not constitute an admission of infringement or liability.
8. Supplier Cooperation
Where a complaint relates to a Product supplied by an independent supplier or manufacturer, iCaseTheory may:
- seek information from the supplier;
- request evidence of licences or authorisations;
- suspend further purchases from that supplier;
- require the supplier to cooperate fully with the investigation.
Where appropriate, iCaseTheory may seek reimbursement or other contractual remedies from the relevant supplier.
9. Repeat Infringement
iCaseTheory reserves the right to permanently discontinue the sale of Products supplied by any supplier that repeatedly provides Products found, or reasonably believed, to infringe third-party intellectual property rights.
10. No Admission of Liability
Receipt of a complaint, temporary removal of a Product or investigation by iCaseTheory shall not be construed as an admission that any infringement has occurred.
iCaseTheory reserves all legal rights and remedies.
11. False or Misleading Complaints
Persons submitting complaints must do so honestly and in good faith.
iCaseTheory reserves the right to reject complaints that are:
- frivolous;
- malicious;
- misleading;
- unsupported by reasonable evidence; or
- submitted for anti-competitive or improper purposes.
Where permitted by applicable law, iCaseTheory reserves the right to pursue appropriate legal remedies in relation to knowingly false or fraudulent complaints.
